GENERAL CONDITIONS OF SALE

 
Preamble 

The purpose of the General Conditions of Sale is to define the conditions under which the sales of products offered by the company ÏZZA are carried out through its online store on the website www.izzaatelier.com

These GCS are formalized between ÏZZA and any non-commercial natural person (hereinafter, "the Buyer" or "the User") who wishes to make a purchase on the "Website".

The parties agree that these GCS and this Privacy Policy exclusively govern their relationship.

ÏZZA reserves the right to modify the GCS from time to time. However, the applicable conditions will be those in force on the date of the order by the Buyer.

If there were no sales requirement, it would be considered to be governed by current practices in the distance selling sector whose companies have their registered office in Spain.

ÏZZA undertakes to comply with all the provisions of the Consumer Code relating to distance selling.

Article 1: Purpose

These General Terms and Conditions of Sale, as well as the Privacy Policy on this page determine the rights and obligations of the parties in the context of the online sale of the Products offered by ÏZZA.

Article 2: General provisions

These General Terms and Conditions of Sale (CGV) apply to all sales of Products, made on the izzaatelier.com website that are an integral part of the Contract between the Buyer and the Seller. Ïzza reserves the right to modify these terms and conditions at any time by posting a new version on its website.

The applicable GCS are then those in force on the date of payment (or the first payment in the case of multiple payments) of the order.

The Client declares to have read all these General Conditions of Sale, and where appropriate the Particular Conditions of Sale related to a product or service, and accept them without restrictions or reservations.
Therefore, any order placed on the ÏZZA website implies unreserved acceptance of these GCS and the Privacy Policy of our page by the Buyer.

Article 3: Products
The products regulated by these GCS are those that appear on the Website and that are indicated as sold and shipped by Ïzza. They are offered within the limits of available stocks.

The Products are described and presented as accurately as possible. However, if errors or omissions may have occurred in this presentation, Ïzza cannot be held responsible.
The photographs of the products are not contractual unless otherwise indicated.

Article 4: Price

The prices of the products sold are those in force on the day of the order. They are denominated in euros.

All prices are VAT included.

The prices indicated do not include the shipping costs that are then indicated and invoiced when the order is registered by the Buyer.

On the other hand, any customs duties or other local taxes that may be due, are the sole responsibility of the Buyer.

ÏZZA is exempt from any legal responsibility if the payment of taxes was not made by the Buyer.

ÏZZA reserves the right to change the prices of the products at any time, except for the ordered products, which will remain at the price indicated when placing the order.

Article 5: Retention of Title Clause

The products remain the property of ÏZZA until full payment of the price.

Article 6: Terms of delivery 

The customer is solely responsible for a non-delivery due to an error in communicating their data at the time of placing the order.

After the confirmation of the order, ÏZZA undertakes to deliver to the courier service all the references requested by the Buyer within a maximum period of 5 business days in Spain (unless otherwise indicated).

Delivery is by registered letter for Spain and the EU, and certified international letter or package for all other destinations from Spain.

Delivery times are on average:

-for Spain: between 1 and 3 days

-for Europe: between 3 and 8 days

Shipping costs include packaging and postage.

Any order placed on the site and delivered outside of Spain may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the customer.

To know them, it is up to the client to consult with the competent authorities of his country.

In case of late delivery, the Customer has the possibility to terminate the contract under the terms and conditions defined in article L 138-2 of the Consumer Code. The Seller then reimburses the product and the shipping costs under the conditions of article L 138-3 of the Consumer Code.

Article 7: Form of payment

The price charged to the customer is the price indicated in the order confirmation.

Possible forms of payment (at the Client's choice)

– By PayPal (with Visa credit card): Payment is made by credit card with the cb symbol through the PayPal secure online payment site. By choosing to pay via PayPal, the Buyer will be automatically directed to the PayPal website. You are not required to have a PayPal account in order to pay for your order. Once the PayPal payment has been validated, your order will be taken into account.

– With Bizum: Through a transaction carried out in direct communication with the vendor who will issue the payment letter and the corresponding data.

– With credit card

The currency used for the transaction is the euro. To be registered, the order must be paid in full. Unpaid orders cannot be delivered. The invoice or delivery note corresponding to the order on the site will be attached to the delivery. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their consent. 

In case of rejection by said centers, the order will be automatically canceled and the customer will be notified by email.

In addition, ÏZZA reserves the right to refuse any order from a customer with whom there is a dispute.

Article 8: Withdrawal period

According to article L. 121-20 of the Consumer Code, "the consumer has a period of fourteen (14) working days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, if necessary , of the return costs".

However, products returned incomplete, personalized, worn, damaged (except in case of defect) or soiled are not returned.

The Buyer can return the Products to ÏZZA by post either in Registered Letter (without insurance in case of loss but with a tracking number) or in Registered Package (with insurance and tracking number). You must communicate  the tracking number of the package as soon as possible by email to faizadesing@gmail.com.

Return costs are the sole responsibility of the Buyer with the exception of a defective Product upon receipt, or an error in shipping the Product.

Product returns must be made in their original and complete condition (packaging, accessories, instructions...) so that they can be re-marketed in new conditions; if possible, they should be accompanied by a copy of the proof of purchase.
Ïzza will reimburse the Buyer only for returned Products (shipping and package processing costs remain the responsibility of the Buyer), subject to compliance with the conditions mentioned above.
The refund will be made by card, Bizum or bank transfer (to be specified when requesting a refund).

Article 9: Changes

Buyer also has seven (7) days to request a change.

Buyer will not need to pay shipping fee on new exchange order. The Buyer can return the Products to Ïzza by post (same procedure as for the refund).

As a reminder, the return costs by Correos remain the responsibility of the Buyer and the Products to be withdrawn must be intact, complete, packed in the original packaging.

Article 10: Intellectual property rights

Trademarks, domain names, products, software, images, videos, texts or, in general, any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these GCS. Any reproduction, modification or total or partial use of these goods for any reason is strictly prohibited.


Article 11: Personal data
The information and personal data are necessary for the management of orders, as well as for the improvement of commercial relations with the Internet user. In this spirit, Ïzza is committed to protecting the privacy of the Internet user who visits its website and guarantees the confidentiality of their information.

Article 12: Force majeure

The fulfillment of the seller's obligations at the end of these terms is suspended in the event of a fortuitous event or force majeure that prevents its execution. The seller will notify the customer of the occurrence of said event as soon as possible.

Article 13: Dispute resolution and applicable rights

Sales concluded with ÏZZA through the website www.izzaatelier.com are subject to Spanish law.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to expose their situations. In the event of a dispute, the customer will first contact the company for an amicable solution.

Failing that, for all disputes that may give rise to this contract, relating to its validity, interpretation, execution, termination, its consequences and its consequences, they will be submitted to the competent court in accordance with the rules of common law jurisdiction.
